1. Agreement to Terms
By accessing or using Treffer, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.
2. Description of Service
Treffer is a data platform that provides business information about companies, with a focus on Germany, primarily through an API. Access is metered through credits included in your subscription plan.
3. User Accounts
To use certain features of our platform, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
- Not share your account with others
4. Fees, Subscriptions and Credits
- Subscription fees are billed in advance for each billing period and are non-refundable, except where a refund is required by law or expressly stated by us
- Each plan includes a credit allowance. Credits are consumed by successful lookups as described on the pricing page and in the documentation
- Unless expressly stated otherwise on the pricing page, credits have no cash value, are non-transferable, and expire as described for your plan
- We may change prices and plan structures. Changes take effect at the start of your next billing period after notice
- We may suspend access when a payment fails or an account balance is overdue
- You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period
5. API Usage
When using the Treffer API, you agree to:
- Keep your API keys confidential and not share them with third parties
- Use the data you retrieve in compliance with applicable laws, including data protection laws
- Not circumvent usage limits, rate limits, or credit metering
- Not resell or redistribute the platform's data as a standalone product
- Not use automated means to extract data outside the documented API
6. Your Responsibility for Data Use and Outreach
You are solely responsible for how you use the data you retrieve from the platform. In particular:
- You are solely responsible for the legality of any outreach, marketing, or other communication you conduct using the data, under all laws that apply to you and your recipients, including competition, anti-spam, marketing, and data protection laws (for example the German Act Against Unfair Competition, UWG)
- We make no representation that the use of any data for any particular purpose, including contacting the persons or companies concerned, is lawful in your jurisdiction or theirs
- You are responsible for obtaining any consents or legal bases your use of the data may require
7. Prohibited Activities
You may not:
- Use the platform for any illegal purposes
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the platform
- Circumvent security measures, usage limits, or credit metering
- Misrepresent your identity or affiliation when using the platform
- Violate intellectual property rights
8. Intellectual Property
All content on Treffer, including text, graphics, logos, and software, is owned by Treffer or our licensors and is protected by copyright and trademark laws. You may not copy, modify, or distribute our content without permission.
Data retrieved through the API may be used within your own business and products, subject to the restrictions in these terms.
9. Disclaimer of Warranties
Treffer is provided "as is" without warranties of any kind. We do not guarantee:
- The accuracy, completeness, or timeliness of the data provided
- That the service will be uninterrupted or error-free
- That defects will be corrected
You use our platform at your own risk. You remain responsible for how you use the data in your own business.
10. Limitation of Liability
To the maximum extent permitted by law, Treffer and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
We are not responsible for:
- Decisions made based on the data provided
- Financial losses arising from your use of the platform
- Your compliance with laws that apply to your use of the data
11. Indemnification
You agree to indemnify and hold Treffer harmless from any claims, damages, or expenses arising from your use of the platform, your use of the data, or your violation of these terms.
12. Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these terms
- Fraudulent or illegal activity
- Abuse of the platform
- Any other reason at our sole discretion
You may terminate your account at any time by contacting us.
13. Third-Party Services
Our platform may integrate with third-party services (payment processors, analytics, etc.). Your use of these services is subject to their own terms and conditions.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
